Welcome to Black Label Diesel Tuning. Our website, www.blacklabeldieseltuning.ca (the "Site"), provides diesel performance products, custom tuning services, tuning devices, vehicle hardware, and related products, services, and information.

By accessing or using the Site, purchasing products or services, creating an account, submitting vehicle information, downloading tuning files, or otherwise using our services, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, do not use the Site or purchase our products or services.

Products, Services, and Orders

All products, services, tuning services, hardware, devices, and related items are subject to availability.

Black Label Diesel Tuning reserves the right to:

• Limit quantities.
• Reject or cancel an order.
• Discontinue any product or service.
• Correct pricing, product descriptions, specifications, or other errors.
• Modify products, services, pricing, or availability without prior notice.

Prices are subject to change without notice.

We make reasonable efforts to ensure that product descriptions, pricing, specifications, fitment information, photographs, and other information are accurate. However, errors may occur, and Black Label Diesel Tuning is not responsible for typographical, technical, pricing, or descriptive errors.

If an error affects an order, we reserve the right to correct the error or cancel the affected order and issue any applicable refund.

Custom Tuning Services

Custom tuning services are created based on the vehicle information, modifications, hardware, configuration, and other information supplied by the customer.

Tuning results may vary based on factors including, but not limited to:

• Vehicle condition.
• Existing mechanical or electrical problems.
• Vehicle modifications.
• Fuel quality.
• Maintenance history.
• Installed hardware.
• Transmission or drivetrain condition.
• Customer-supplied vehicle information.
• Local laws and regulations.

The customer is responsible for providing complete and accurate vehicle information.

Black Label Diesel Tuning is not responsible for problems, delays, tuning incompatibilities, or vehicle damage caused by inaccurate, incomplete, or misleading information supplied by the customer.

Custom tuning may affect vehicle drivability, reliability, emissions compliance, fuel economy, manufacturer warranties, or component life.

By purchasing or using tuning services, you acknowledge and accept these risks.

Emissions and Legal Compliance

Certain tuning products, performance parts, exhaust components, emissions-related components, and vehicle modifications may not be legal for use on public roads or registered highway vehicles in certain jurisdictions.

Some products may be intended solely for:

• Off-road use.
• Competition vehicles.
• Racing applications.
• Export applications.
• Vehicles otherwise exempt from applicable emissions requirements.

It is the customer's sole responsibility to determine whether a product, tune, modification, or configuration is legal for the customer's intended application and location.

Black Label Diesel Tuning does not authorize or encourage the unlawful modification, disabling, removal, or circumvention of legally required emissions-control systems.

The customer assumes responsibility for compliance with all applicable federal, provincial, state, territorial, and local laws and regulations.

Performance Parts and Hardware

Performance products and vehicle modifications may place additional stress on engines, transmissions, driveline components, emissions systems, fuel systems, turbochargers, and other vehicle components.

Installation and use are at the customer's own risk.

Professional installation is strongly recommended where appropriate.

Black Label Diesel Tuning is not responsible for damage caused by:

• Improper installation.
• Incorrect product selection.
• Incompatible modifications.
• Pre-existing mechanical problems.
• Improper vehicle operation.
• Racing or competition use.
• Abuse, misuse, or neglect.

Shipping and Delivery

Shipping and delivery dates are estimates only and are not guaranteed unless expressly stated otherwise.

Black Label Diesel Tuning is not responsible for delays caused by shipping carriers, customs agencies, weather, natural disasters, labor disruptions, address errors, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Risk of loss or damage transfers to the customer when the order is transferred to the shipping carrier, except where applicable law provides otherwise.

Additional duties, taxes, brokerage fees, customs charges, or import fees may apply to international shipments and are the responsibility of the customer unless otherwise stated.

Returns and Refunds

Eligible physical products may be returned within the return period stated at the time of purchase, generally 14 to 30 days after delivery, provided the product is unused, uninstalled, undamaged, and returned in its original condition and packaging.

Return authorization may be required before sending a product back.

Non-Returnable and Non-Refundable Items

The following are FINAL SALE unless otherwise required by applicable law:

• Custom tuning services.
• Custom-created tune files.
• Tune revisions or custom calibrations.
• Downloadable or electronically delivered products.
• Flashed, programmed, licensed, married, VIN-locked, or activated devices.
• Custom-ordered or specially configured products.
• Products that have been installed, altered, damaged, or used.

Once work has begun on a custom tuning order, the order may not be eligible for cancellation or refund.

Shipping charges are non-refundable unless required by law or the return is the result of an error by Black Label Diesel Tuning.

Customers are responsible for return shipping costs unless the item received was incorrect or defective.

Tuning Files and Digital Products

Tuning files and other digital products are licensed to the original purchaser for use with the approved vehicle, device, VIN, ECM/PCM, or application for which they were created.

Unless specifically authorized in writing, customers may not:

• Resell tuning files.
• Redistribute tuning files.
• Share tuning files with third parties.
• Upload tuning files to public websites or file-sharing services.
• Reverse engineer, modify, extract, or commercially reproduce proprietary tuning data.
• Use a tune created for one vehicle on another vehicle.

Unauthorized distribution or use may result in termination of access to Black Label Diesel Tuning services without refund and may violate intellectual-property laws.

Intellectual Property

All content appearing on the Site, including but not limited to:

• Text.
• Graphics.
• Logos.
• Images.
• Videos.
• Product descriptions.
• Software.
• Website design.
• Tuning files.
• Calibration data.
• Documentation.
• Branding.

is owned by, licensed to, or used with permission by Black Label Diesel Tuning and is protected by applicable copyright, trademark, intellectual-property, and other laws.

You may not copy, reproduce, republish, distribute, modify, sell, license, or create derivative works from our content without prior written authorization.

User Content

If you submit reviews, photographs, videos, testimonials, comments, vehicle information, or other content to Black Label Diesel Tuning, you represent that you have the right to provide that content.

You grant Black Label Diesel Tuning a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and publish submitted content for legitimate business, promotional, marketing, support, and operational purposes.

You may not submit content that:

• Violates applicable law.
• Infringes another person's intellectual-property rights.
• Contains malicious software or code.
• Is fraudulent or intentionally misleading.
• Contains unlawful threats or harassment.

Acceptable Use

You agree not to:

• Use the Site for unlawful purposes.
• Attempt to gain unauthorized access to accounts, servers, systems, or data.
• Introduce viruses, malware, malicious scripts, or harmful code.

Customer Accounts

Customers are responsible for maintaining the confidentiality of their account credentials.

You are responsible for activity conducted through your account unless prohibited by applicable law.

You must promptly notify Black Label Diesel Tuning if you believe your account has been accessed without authorization.

Customer portal access, order records, tune downloads, or related services may be suspended when fraud, unauthorized access, misuse, or violations of these Terms are reasonably suspected.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS, TUNING SERVICES, INFORMATION, AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

BLACK LABEL DIESEL TUNING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, EXCEPT WHERE SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

Vehicle performance, reliability, fuel economy, horsepower, torque, drivability, or other results are not guaranteed unless expressly stated in writing.

Assumption of Risk

Vehicle modification and performance tuning involve inherent risks.

These risks may include, but are not limited to:

• Engine damage.
• Transmission damage.
• Turbocharger damage.
• Drivetrain failure.
• Increased component wear.
• Changes in vehicle handling or drivability.
• Warranty denial.
• Emissions-compliance issues.
• Vehicle downtime.

By purchasing, installing, or using our products or services, you acknowledge these risks and voluntarily assume responsibility for them to the fullest extent permitted by law.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLACK LABEL DIESEL TUNING, ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, TUNERS, OR AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SITE, PRODUCTS, TUNING SERVICES, OR VEHICLE MODIFICATIONS.

THIS INCLUDES, WITHOUT LIMITATION:

• LOST PROFITS.
• LOST REVENUE.
• LOST DATA.
• BUSINESS INTERRUPTION.
• TOWING COSTS.
• RENTAL VEHICLE COSTS.
• VEHICLE DOWNTIME.
• ENGINE OR TRANSMISSION DAMAGE.
• LOSS OF USE OF A VEHICLE.

This limitation applies even if Black Label Diesel Tuning has been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot legally be limited or excluded under applicable law.

Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Black Label Diesel Tuning and its owners, employees, contractors, affiliates, tuners, suppliers, and agents from claims, losses, liabilities, damages, expenses, and reasonable legal fees arising from or relating to:

• Your use of the Site.
• Your purchase or use of products or services.
• Vehicle modifications performed by you or on your behalf.
• Violation of applicable laws or regulations.
• Your violation of these Terms.
• Information or content you submit.
• Improper installation, use, modification, or resale of our products or services.

Changes to These Terms

Black Label Diesel Tuning may modify these Terms and Conditions from time to time.

Updated Terms will be posted on www.blacklabeldieseltuning.ca and become effective as stated in the updated version.

Continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
